Privacy policy of the BMWKMS in accordance with Art. 13 GDPR

The responsible handling of personal data is a matter of course for the Federal Ministry of Housing, Arts, Culture, Media and Sport (BMWKMS). Due to the further development of our websites and the implementation of new technologies, it may be necessary to update the data protection statement. We therefore recommend that you re-read this data protection statement from time to time.

Legal basis for data protection

Server logs

Each time you access the BMWKMS website, the following data is stored in a log file (server logs) for a limited period of time:

  • IP address of the enquirer
  • Enquiry details and destination address
  • Name of the retrieved file and amount of data transferred
  • Date and time of retrieval
  • Notification of whether the call was successful
  • Processing time of the request in microseconds
  • User agent used
  • SSL version used
  • Referrer
  • Version of the http protocol used
  • http method

Purpose

This data is used exclusively to check system security. There is no personalised analysis or profiling.

Legal basis

The lawfulness of the data processing is based on Art. 6 (1)(e) GDPR: The processing serves public interests. The legal basis for processing pursuant to Art. 6 (1)(e) GDPR is the Federal Ministries Act 1986.

Provision of the data

The provision of personal data for this purpose is neither legally nor contractually required. The non-provision of data is possible if the department's websites are not visited.

Recipient categories

Processor of the department, if applicable. There is no personalised analysis or profiling. Nevertheless, we reserve the right to analyse your IP address in the event of attacks on the department's internet infrastructure. If a criminal offence is suspected, the data must be transmitted to the law enforcement authorities in accordance with the applicable regulations.

Retention period

Server logs are stored for a limited period of 30 days.

Contact form, emailing, orders and other contacts

Data that you provide to us via online forms or by email (e.g. contact form, newsletter registration, registration for events, input on questions) will be handled responsibly by our employees.

Purpose

BMWKMS requires at least your email address in order to send you information. When ordering newsletters, information material or other products via the website, you will therefore be asked for your email address and, if necessary, some additional contact details. The processing of contact details for the respective purpose is only permitted if you have given your consent to BMWKMS.

Legal basis

The lawfulness of the data processing is based on Art. 6 (1)(a) GDPR: The processing is based on the express consent of the data subject.

Provision of the data

The option of providing your contact details, giving your consent to the processing of data and information on your rights under the GDPR, including the right to withdraw your consent, can be found in the respective service offer. If you give your consent, your data will only be used for the purpose for which you provide the data. If you do not provide your data, the respective service cannot be used. 

Retention period

The data will be stored for as long as this is necessary for this purpose and you have not withdrawn your consent to data processing.

Matomo analysis tool

The website www.bmwkms.gv.at uses the Matomo analysis tool without cookies. However, usage information is sent in order to statistically analyse website usage, for which your IP address is immediately anonymised. Therefore, no personal data is stored for statistical analyses. Matomo Privacy Policy

BMWKMS uses the services of etracker GmbH from Hamburg, Germany (www.etracker.com), to analyse usage data for the website bmwkms.gv.at. No cookies are placed for web analysis by default. Insofar as we use analysis and optimisation cookies, we will obtain your explicit consent separately in advance. If this is the case and you agree, cookies will be used to statistically analyse the reach of this website and to measure the success of our online activities. Cookies are small text files that are stored by the internet browser on the user's end device. etracker cookies do not contain any information that makes it possible to identify a user.

The data generated with etracker is processed and stored by etracker on behalf of the provider of this website exclusively in Germany and is therefore subject to strict German and European data protection laws and standards. etracker has been independently audited, certified and awarded the data protection seal of approval ePrivacyseal.

Data processing is carried out on the basis of the legal provisions of Art. 6 (1)(f) (legitimate interest) of the General Data Protection Regulation (GDPR). Our concern within the meaning of the GDPR (legitimate interest) is the optimisation of our online offering and our website. Since the privacy of our visitors is important to us, any data that could be linked to an individual, such as the IP address, login or device identifiers, will be anonymised or pseudonymised as soon as possible. The data will not be used for any other purpose, merged with other data or disclosed to third parties.

You can object to the data processing described above at any time on the Cookie settings page. The objection has no adverse consequences.

Publication of information containing personal data

Some personal data (in particular names) are published on the BMWKMS website (e.g. members of commissions and working groups, advisory boards and boards of trustees, supervisory boards, contact persons for various topics, participants in events, juries, award winners, deceased award winners, recipients of awards and prizes) for the purpose of providing contact and networking information or for documentation purposes.

Personal data is published in press releases in the public interest on the legal basis of Article 6 (1)(e) GDPR.

Purpose

Public relations work of the department (information about events or matters of public interest in the department's area of activity). 

Legal bases

The lawfulness of the processing is based on the following articles:

  • where the data subject has consented to publication, on Art. 6 (1)(a) GDPR: The data subject has consented to the processing of the data for the purpose.
  • where the publication is based on a contract, on Art. 6 (1)(b) GDPR: Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
  • otherwise on Art. 6 (1)(e) GDPR: Processing is necessary for the performance of a task carried out in the public interest. The legal basis for processing pursuant to Art. 6 (1)(e) GDPR is the Federal Ministries Act 1986.

Provision of the data

The provision of personal data is not required by law, but may be required by contract. Failure to provide the data would mean that it would not be possible to use the personal data to inform the public.

Recipient categories

The data will not be transmitted. It is accessible to visitors to the website. If necessary, the department's processors will have access to the data.

Retention period

The data and information will remain on the website for as long as is necessary for the respective purpose or as contractually agreed. Where consent forms the basis for processing, the processing will continue for as long as the consent is not withdrawn.

Note on the rights of data subjects

In some cases, some of the data subject rights do not apply. These are: the right to object pursuant to Art. 21 GDPR, which does not apply in cases in which data processing is carried out on the basis of Art. 6 (1)(a) or (b) GDPR; the rights to erasure and data portability pursuant to Art. 17 and 20 GDPR, which does not apply in cases on the basis of Art. 6 (1)(e) GDPR.

Profiling

No personal user profiles will be created.

Transfer of personal data to third parties

When ordering newsletters or other information, you will be informed on the relevant page that your contact details required for the mailing may be transmitted to distribution companies commissioned by BMWKMS as recipients of the data. This will only happen if you have also given your consent to this. Otherwise, data will only be transmitted to third parties to the extent that and for as long as it are processed in connection with the website or the services listed, in accordance with legal obligations, for example if this is required by court order or, in the event of attacks on the internet infrastructure, for legal or criminal prosecution.  

Protection of minors

Persons under the age of 14 should not transmit any personal data to us without the consent of their parents or legal guardians. We do not request personal data from children and young people. We do not knowingly collect such data and do not disclose it to third parties.

In the case of an offer of information society services made directly to a child, consent to the processing of the child's personal data is lawful pursuant to Art. 6 (1)(a) GDPR if the child has reached the age of fourteen.

Links to websites of other providers

Our online offer contains links to websites of other providers. We have no influence over whether these providers comply with data protection regulations.

Your rights

Note on the rights of data subject

In principle, you have the right to information, rectification, erasure, restriction, data portability, cancellation and objection. If you believe that the processing of your data violates data protection law or that your data protection rights have been violated in any other way, you can lodge a complaint with the supervisory authority. In Austria, this is the Data Protection Authority.

You can use the following information provided to you under the General Data Protection Regulation by sending an informal request to BMWKMS:

  • You have the right to information, i.e. you can request confirmation as to whether data relating to your person is being processed. If this is the case, you have the right to be informed about the personal data that has been processed (Art. 15 GDPR).
  • If the data relating to your person is processed incorrectly, you have the right to request rectification. If you determine that the data is being processed incompletely, you can request the completion of the data (Art. 16 GDPR).
  • You have the right to demand that the personal data relating to you be erased immediately (Art. 17 GDPR); this request must be complied with if the conditions set out in this provision are met.
  • In the event that rectification or erasure can only be carried out at certain times for economic or technical reasons, processing of the data concerned must be restricted until rectification or erasure has taken place (Section 4 (2) of the Data Protection Act). Restriction of processing means that the data relating to your person, apart from being stored, may only be processed further with your consent or for specific reasons regulated by law.
  • You have the right to request the restriction of the processing of your data if you
    1. contest the accuracy of your processed data for a period that enables BMWKMS to verify the accuracy of the personal data,
    2. favour the restriction of data processing instead of the right to erasure of unlawfully processed data,
    3. you need the data for your legal claims and therefore do not want BMWKMS to erase it, even though BMWKMS no longer needs it for the purposes for which it was collected (Art. 18 GDPR).

The exercise of these rights is not associated with any costs for you.

However, in the case of manifestly unfounded or excessive applications — especially in the case of frequent repetition — a reasonable fee may be charged, taking into account the administrative costs, or your application may not be processed.

Complaint to the data protection supervisory authority

You have the right to lodge a complaint with the data protection supervisory authority – in Austria this is the Data Protection Authority – if you believe that the processing of your personal data violates the General Data Protection Regulation (Art. 77 GDPR).

Controller

BMWKMS decides on the above-mentioned purposes and means of data processing and is therefore the controller within the meaning of Art. 4 (7) GDPR.
